No Smoking Policy

Smoke-Free Housing Policy 

Dear Residents, 

An update to the Smoke-Free Housing Policy has been approved by the Eustis Housing Authority Board as of January 27, 2026. This updated policy is effective immediately for ALL properties owned by the Eustis Housing Authority (EHA).

All residents of the Eustis Housing Authority and Tall Pines Villas who are 18 years of age or older are required to visit the leasing office to sign and receive their copy of the Smoke-Free Housing Policy Lease Addendum on or before March 2, 2026. If the addendum is not signed by this date, you will receive a Non-Compliance Notice, as adherence to this policy is a requirement for living on ALL properties owned by the Eustis Housing Authority (EHA).

Tenants should understand that violating the Smoke-Free Housing Policy Lease Addendum anywhere on EHA property (HUD public housing and Tall Pines Villas) will be considered a material default under the lease agreement. This may result in the termination of the resident's lease according to the terms and conditions outlined in the lease.

Smoke-Free Housing Policy Lease Addendum 

Effective October 1, 2017, ALL properties owned by the Eustis Housing Authority (EHA) will be considered "smoke-free" communities, in accordance with provisions of U.S. HUD's Final Ruling [FR-5597-F-03] regulation established on December 5, 2016. This provision is also being established in accordance with HUD Notice PIH-2012-25 and HUD Notice H-2012-22, 24 CFR 903. 7( e )(1) and 24 CFR Parts 965 and 966. It has been well established that smoking cessation has demonstrated health benefits, and that second-hand smoke represents a serious health risk to non-smokers.

For the purpose of the Smoke-Free Housing Policy Lease Addendum ("Policy"), "smoking" shall include, but is not limited to, the inhaling, exhaling, or carrying of any lighted cigarette, e-cigarette, vaping device, cigar, pipe, hookah, other tobacco or plant products, marijuana (including medicinal marijuana), herbal smoking products ("Legal Weed"), products known as "bath salts", or any other legal/illegal substances.

  1. Smoking will not be permitted anywhere on EHA premises, in accordance with the following guidelines:
    • No smoking permitted anywhere inside or outside the apartment units.
    • No smoking permitted anywhere along walkways, breezeways, patios or general open air spaces.
    • No smoking permitted on designated gardens, playgrounds or designated recreation areas.
    • No smoking permitted at any management office owned by EHA.
    • No smoking permitted by any employee of EHA, Board members, contractors or guests visiting any EHA property.

  2. All current residents, employees, guests, and new residents of EHA after this date will be prohibited from smoking anywhere on EHA property (HUD Public Housing and Tall Pines Villas). There will be no smoking exemptions provided.

  3. Resident shall comply with this Policy and ensure that all members of resident's household, guests, and other persons under resident's control shall comply with this Policy.

  4. It is the responsibility of all residents to notify their guests of this Policy.

  5. "No Smoking" signs will be posted throughout all properties owned by the EHA, to inform all tenants, staff, guests and invitees of the Policy.

  6. If a resident smells tobacco smoke or witnesses a resident (or other individual) smoking (as outlined in this Policy), the resident should report this to Management, in writing, as soon as possible. Management will attempt to seek the source of the smoking violation and take appropriate action.

  7. All residents will be given a copy of the Smoke-Free Housing Policy Lease Addendum, at their time of move-in and will be provide with a copy of any revised and/or updated Policy Addendum during the course of their tenancy. After review, the resident must sign the Smoke-Free Policy Lease Addendum and/or any revised or updated Policy Addendum, and it will be placed into the resident's master file.

  8. Violations and Progressive Enforcement. A violation of the Policy constitutes a serious and material violation of the Dwelling Lease and will result in Lease enforcement action by EHA. EHA will use a progressive enforcement approach as follows, except where circumstances warrant more immediate action, as determined by EHA in its sole discretion.

    • First Violation - Written Warning
      Upon the first documented violation, resident will receive a written warning describing the violation, reminding the tenant of the requirements of the Policy, and advising that future violations may result in further enforcement action, up to and including Lease termination.

    • Second Violation - Final Written Warning
      Upon a second documented violation, the resident will receive a final written warning stating that continued noncompliance constitutes a serious and material Lease violation, and that a third violation will result in Lease termination.

    • Third Violation - Lease Termination
      Upon the third documented violation, EHA will terminate the resident's Lease in accordance with the terms and conditions of the Lease.

  9. EHA may provide information to residents regarding smoking cessation resources as part of its compliance efforts.

  10. Smoking-Related Damages. The resident shall be responsible for the cost of repairing any damage to the dwelling unit, common areas or EHA property caused by smoking in violation of this Policy, whether such damage occurs during the tenancy or is discovered at move-out. Smoking-related damage may include, but is not limited to, burns, scorch marks, residue, staining, or odors requiring cleaning, repainting, replacement of flooring, fixtures, or other material beyond ordinary wear and tear. EHA may assess charges for actual and reasonable cost incurred to resort the unit to a smoke-free condition, consistent with the Lease and/or HUD regulations. Any such charges may be deducted from the resident's security deposit at move-out, or otherwise billed to the resident during resident's tenancy.

  11. EHA 's adoption of a smoke-free living environment, and the efforts to designate its properties as smoke free, do not make EHA the guarantor of resident's health or of the smoke-free condition of the resident's unit and the common areas nor does it in any way change the standard of care that EHA would have to a resident household to render buildings and premises designated as smoke-free any safer, more habitable, or improved in terms of air quality standards than any other rental premises. However, EHA will take reasonable steps to enforce the smoke-free terms of its Leases and this Policy in order to make its properties smoke-free.

  12. EHA specifically disclaims any implied or express warranties that the building, common areas, or resident's unit will have any higher or improved air quality standards than any other rental property. EHA cannot and does not warrant or promise that the rental premises or common areas will be free from secondhand smoke. EHA's ability to police, monitor or enforce the Policy is dependent in significant part on mandatory compliance by resident and resident's guests. Residents with respiratory ailments, allergies, or any other physical or mental condition relating to smoke are put on notice that EHA does not assume any higher duty of care to enforce this Policy than any other EHA obligation under the Lease.

  13. Eustis Housing Authority (Owner) authorizes Dimension One Management (Agent) to enforce this policy for residents of Tall Pines Villas in accordance with the guidelines established herein.
